Matter of Castillo-Perez

According to an October 25, 2019  decision by the Attorney General in Matter of Thomas and Thompson [27 I&N Dec. 674 (A.G. 2019)], state court orders modifying or altering an alien’s conviction will only have legal effect for immigration purposes when based on a “procedural or substantive defect in the underlying criminal proceeding,” but not when changed for reasons unrelated to the merits of the case.
